EU Proposes Directive to Harmonize Transfer Pricing Rules

The European Union is taking a significant step towards tax regulation consistency across member states with the proposed introduction of a directive on Transfer Pricing, part of the broader BEFIT package.

The core aim is to ensure that enterprises engaging in cross-border transactions within the EU assess their taxable profits in line with the arm’s length principle.

This principle will be enforced through a common definition of “Associated Enterprise,with criteria based on management participation, control, capital ownership, and profit entitlement.

Key transfer pricing issues such as method selection, transaction identification, adjustments, comparability analysis, documentation, and determining arm’s length ranges will be regulated, aiming to reduce disputes and foster a more cohesive tax environment in the EU.
